Significant Investor Visa and Investor Visa

The Australian Government’s Significant Investor Visa (SIV) and Investor Visa (IV) are streams within the Australian Government’s Business Innovation and Investment (Provisional) (Subclass 188) visa and the Business Innovation and Investment (Permanent) (Subclass 888) visa which enables a high net worth individual the ability to migrate to Australia and secure permanent residency. Provisional SIV holders invited to apply for this visa after 1 July 2021 are required to invest $5 million (AUD) into complying significant investments for the duration of the provisional visa. Provisional SIV holders may be eligible to apply for a permanent visa after holding the visa for at least three years or through the Significant Investor Visa Extension stream and also after having satisfied the other requirements.

Provisional IV holders invited to apply after 1 July 2021 are required to invest $2.5 million (AUD) into complying significant investments for the duration of the provisional visa. Provisional IV holders may be eligible to apply for a permanent visa after holding the visa for at least three years and satisfying the other requirements.

The SIV complying investment rules were changed in 2021 by the Australian Government and from 1 July 2021, SIV applicants are required to invest at least $5 million (AUD) in complying investments, which must include:

  • Up to $2.5 million in one or more balancing investment(s), such as managed funds that invest in a combination of eligible assets that include Australian listed securities, eligible corporate bonds or notes, annuities and real property (subject to the 10% limit on residential real estate)

  • At least $1.5 million invested in an Australian emerging companies fund

  • At least $1 million in an Australian venture capital or growth private equity fund(s)

The IV complying investment rules were changed in 2021 by the Australian Government to be consistent with the SIV complying investment rules. From 1 July 2021, IV applicants are required to invest at least $2.5 million (AUD) in complying investments, which must include:

  • Up to $1.25 million in one or more balancing investment(s), such as managed funds that invest in a combination of eligible assets that include Australian listed securities, eligible corporate bonds or notes, annuities and real property (subject to the 10% limit on residential real estate)

  • At least $0.75 million invested in an Australian emerging companies fund

  • At least $0.5 million in an Australian venture capital or growth private equity fund(s)

Under both the SIV and the IV rules, the Dexus AREIT Fund qualifies as a complying balancing investment.
